Copyright / DMCA Policy
cubeupload.com responds to notices of alleged copyright infringement that comply with the US Digital Millennium Copyright Act (DMCA), and to equivalent notices under the law of other countries.
Sending a notice
Email dmca@cubeupload.com. Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you say has been infringed.
- The address (URL) of each image you want removed, specific enough for us to locate it.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorised by the rights holder, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf.
Incomplete notices may not be actioned. Knowingly misrepresenting that material is infringing can make you liable for damages.
Designated agent
[TODO: confirm the registered DMCA designated agent’s name and contact details and the US Copyright Office registration number, and add them here.]
Counter-notices
If your image was removed and you believe that was a mistake or misidentification,
you can send a counter-notice to dmca@cubeupload.com with your signature, the
image and its former location, your contact details, your consent to the
jurisdiction of the appropriate court, and a statement under penalty of perjury
that you have a good-faith belief the removal was in error. Where the law
provides for it, we may restore the content after a waiting period unless the
original complainant tells us they have filed a court action.
Repeat infringers
Accounts that are the subject of repeated valid infringement notices have their uploads restricted or are removed from the service.
